Kilkenny Control of Horses Bye Laws – Have Your Say

The Kilkenny County Council have opened a public consultation on the Control of Horses Draft Bye Laws 2020. The deadline for submissions is 15 Dec, 2020, 4:00pm.

Our Queries

We have sent two queries regarding the current and draft bye laws to Kilkenny Council and will update this page and our submissions, with a response, once available and then make our submission:

  1. What is the current approval process relating to this statement:

    “Owners of Horses who are registered with Riding Clubs or Riding Establishments approved of by the Council.”
  2. Section 18 “Penalties” is missing from the draft bye-laws.

DEFINITIONS:

Current Proposed Text:

“Race” Means a race, a trial of speed, a time trial, a competition or test in which participants are required to cover a certain distance in a Horse drawn vehicle in the shortest possible time, or an event or occasion which requires a Horse drawn vehicle to be driven furiously resulting in the welfare of the Horse being endangered.

Submission 1:

“Race” Means a race, a trial of speed, a time trial, a competition, a training event or test in which participants are (or a participant is) required to cover a certain distance in a Horse drawn vehicle in the shortest possible time, or an event or occasion which requires a Horse drawn vehicle to be driven furiously resulting in the welfare of the Horse being endangered and or the race or event poses a danger to persons or property or causes a nuisance or where a horse is not under adequate control.

Exclusion area: extend to exclude all streets in Kilkenny city.

Current Proposed Test:

“Horse Drawn” Means a buggy, trap, sulky, carriage, cab, coach or other Vehicle” vehicle which is drawn or propelled by a Horse.

Submission 2:

“Horse Drawn Vehicle” Means a buggy, trap, sulky, carriage, cab, coach or other vehicle which is drawn or propelled by a Horse.

Include Definition of “Vehicle” as per S.46(a) of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012http://www.irishstatutebook.ie/eli/2012/act/16/section/46/enacted/en/html#sec46

‘vehicle’ means a mechanically propelled vehicle, a trailer or semi-trailer, an animal-drawn vehicle or a pedal cycle;”
